Terms and Conditions – Hotel Directory

Definitions

For the purposes of these Terms & Conditions:

  • Platform means the hotel directory website operated by One Instacloud SRL.
  • Operator, we, us refers to One Instacloud SRL.
  • User means any individual or legal entity accessing or using the Platform.
  • Hotel or Accommodation Provider means any user listing a property on the Platform.
  • Listing means any hotel or accommodation profile, including all related content.
  • Booking means any reservation, inquiry, or transaction made directly between a guest and a hotel or via a third-party provider.

1. Operator

This website and hotel directory (the “Platform”) is operated by One Instacloud SRL, a company registered in EU / RO (“Operator”, “we”, “us”).

2. Scope of the Platform (Important)

The Platform is strictly an informational business directory.

  • We do not provide booking, reservation, payment, or travel agency services.
  • We do not process reservations, payments, cancellations, or refunds.
  • Any links, contact forms, phone numbers, or external booking buttons lead directly to third-party websites or the hotel itself.

All bookings, inquiries, and transactions occur outside the Platform and are solely between users and accommodation providers.

3. Eligibility and Accounts

To list a property, users must:

  • Be at least 18 years old
  • Represent a hotel, guesthouse, or accommodation provider
  • Create an account using accurate and complete information

Account holders are responsible for maintaining the confidentiality of their login credentials.

4. Listings and Content

Hotels and accommodation providers:

  • Create, edit, and manage their listings independently
  • Are solely responsible for the accuracy, legality, and completeness of their content
  • Must ensure that descriptions, prices, availability, photos, and contact details are truthful and up to date

We do not verify or guarantee the accuracy of listings.

5. Free Listings and Fees

5.1 Single Property Listings

  • Single hotels or single-property operators may list free of charge for the first year.
  • Free access does not guarantee perpetual free service.

5.2 Chains and Multiple Properties

  • Operators listing multiple properties may be subject to a paid subscription, currently set at USD 99 per year, billed annually in advance.

5.3 Future Pricing

  • We reserve the right to introduce, modify, or adjust fees at any time.
  • Any pricing changes will be communicated in advance and will not apply retroactively.

6. No Booking Responsibility

The Operator:

  • Is not a party to any booking, agreement, or transaction between users and hotels
  • Bears no responsibility for disputes, overbookings, cancellations, pricing errors, or service quality
  • Does not guarantee availability, pricing, or service levels

All contractual relationships exist exclusively between the hotel and the guest.

7. Moderation and Removal

We reserve the right, at our sole discretion, to:

  • Edit, suspend, or remove listings
  • Suspend or terminate accounts
  • Remove content that violates laws, these Terms, or harms the Platform

This may occur without prior notice.

8. Intellectual Property

Users retain ownership of their content but grant the Operator a non-exclusive, royalty-free license to display and promote listings on the Platform.

9. Limitation of Liability

To the maximum extent permitted by law:

  • The Platform is provided “as is” and “as available”
  • We disclaim all warranties, express or implied
  • We are not liable for any direct, indirect, incidental, or consequential damages
  • We are not responsible for losses arising from reliance on listing information or third-party services

10. Data Protection

Personal data is processed in accordance with applicable Romanian and EU data protection laws (GDPR).

11. Changes to the Terms

We may update these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Romania. Any disputes shall be resolved by the competent Romanian courts.
